{"id":123,"date":"2022-11-15T15:17:38","date_gmt":"2022-11-15T20:17:38","guid":{"rendered":"https:\/\/sites.law.duke.edu\/childedlaw\/?p=123"},"modified":"2022-12-20T12:39:41","modified_gmt":"2022-12-20T17:39:41","slug":"longterm","status":"publish","type":"page","link":"https:\/\/sites.law.duke.edu\/childedlaw\/schooldiscipline\/attorneys\/advice\/longterm\/","title":{"rendered":"Procedures for Long-Term Suspensions"},"content":{"rendered":"\t\t<div data-elementor-type=\"wp-post\" data-elementor-id=\"123\" class=\"elementor elementor-123\">\n\t\t\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-b95b2c4 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"b95b2c4\" data-element_type=\"section\" data-e-type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-73760f25\" data-id=\"73760f25\" data-element_type=\"column\" data-e-type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-3b3df03 elementor-widget elementor-widget-heading\" data-id=\"3b3df03\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-xl\">Procedures for Long-Term Suspensions<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-77a707c7 elementor-widget elementor-widget-text-editor\" data-id=\"77a707c7\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><\/p>\n<p>Students in North Carolina public schools facing suspension from school of more than ten school days have the right to a more formal due process hearing to contest the imposition of the suspension and may be represented by an attorney.\u00a0 Although the hearing procedures vary significantly from school district to school district, the same core elements should appear in all school discipline hearings:\u00a0 \u00a0<\/p>\n<ol>\n<li>the student must \u00a0be confronted with the charges prior to suspension (same as with short-term suspension);<\/li>\n<li>the student must be given an opportunity to respond to the charges and offer any defense prior to suspension (same as short-term suspension);<\/li>\n<li>written notice must \u00a0be provided to the student\u2019s parents or guardians informing them of the charges and the opportunity to request a hearing;<\/li>\n<li>upon request, a hearing must be held, whenever possible, within ten school days of the start of the suspension;<\/li>\n<li>the student must be given the opportunity to cross-examine the witnesses who present the school\u2019s evidence;<\/li>\n<li>the student must be permitted to present his or her own testimony and the testimony of any witnesses on his or her behalf;<\/li>\n<li>following the hearing, the principal\u2019s decision to impose a long-term suspension must be approved by the district superintendent;<\/li>\n<li>and the student must be given the opportunity to appeal the superintendent\u2019s decision to the board of education.\u00a0\u00a0<\/li>\n<li><\/li>\n<\/ol>\n<p><\/p>\n<ol class=\"wp-block-list\">\n<li style=\"list-style-type: none;\">\n<ol><\/ol>\n<\/li>\n<\/ol>\n<p><span style=\"color: var( --e-global-color-text ); font-family: var( --e-global-typography-text-font-family ), Sans-serif; font-size: 16px; font-weight: var( --e-global-typography-text-font-weight );\">School discipline proceedings may be either one-tiered or multi-tiered.\u00a0 The principal\u2019s decision to long-term suspend is always just a recommendation; only a superintendent has the statutory authority to suspend a child for more than 10 days and only the school board has the authority to permanently expel a child.\u00a0 In some cases, a fact-finding hearing takes place before the superintendent reviews the recommendation; in other cases, the superintendent reviews the principal\u2019s recommendation and approves it before a hearing is held.\u00a0 Another model has the superintendent or assistant superintendent as the hearing officer and decision maker.\u00a0 In any of those cases, the decision of either the superintendent or the hearing officer\/panel is appealable to the Board of Education.\u00a0 In some districts, the initial hearing is before the Board of Education itself.<\/span><\/p>\n<p><span style=\"color: var( --e-global-color-text );
